Terms of Service

Operated by Shadow Draw Inc., a Delaware corporation (“ShadowDraw,” “Company,” “we,” “us,” or “our”).

By downloading, installing, or using the ShadowDraw mobile application and related services (the “App”), you agree to be bound by these Terms. If you do not agree, you must not use the App.

If you are using the App on behalf of a minor, you represent that you are the minor’s parent or legal guardian and agree to these Terms on their behalf.

1. License; App Is Licensed, Not Sold

The App and all content made available through it are licensed, not sold, to you.

Subject to your compliance with these Terms, ShadowDraw grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App for personal, non-commercial purposes on Apple-branded devices you own or control, in accordance with Apple’s App Store Terms and these Terms.

No ownership rights are transferred to you. ShadowDraw and its licensors retain all right, title, and interest in and to the App, App Content, and all related intellectual property.

2. Description of Services

ShadowDraw is a digital drawing application providing guided, step-by-step instructional drawing tutorials. Users follow stroke-by-stroke visual guidance using an Apple Pencil or compatible stylus.

The App may evolve over time and may include augmented reality (AR) features, camera-assisted drawing tools, or other interactive instructional technologies.

The App:

  • Does not require account creation

  • Does not host community posting features

  • Does not store user-created artwork

  • Provides both free content and subscription-based premium content

All tutorials and instructional materials are accessible only within the App.

3. Use of Device Features; Future AR Functionality

Certain features of the App may require access to device capabilities, including but not limited to:

  • Camera access

  • Motion sensors

  • Stylus input

  • Local storage

Such access is used solely to provide drawing functionality. ShadowDraw does not record or store camera footage unless explicitly stated at the time such functionality is introduced.

Use of AR features constitutes consent to necessary device permissions.

4. Intellectual Property

4.1 Ownership of App Content

All tutorials, guided stroke sequences, lesson structures, artwork files, animations, graphics, text, software, logos, designs, and related materials (collectively, “App Content”) are owned by or licensed to ShadowDraw and are protected by copyright, trademark, and other intellectual property laws.

Independent artists create original works licensed to ShadowDraw. ShadowDraw owns all rights in the instructional and tutorialized versions presented within the App.

Except for the limited license expressly granted, no rights are transferred to you.

4.2 User-Created Artwork

ShadowDraw does not claim ownership of original artwork you create using the App. You retain ownership of your drawings.

However, you may not:

  • Extract, export, copy, or reconstruct tutorial sequences, stroke files, or lesson data for use outside the App

  • Copy full tutorial lessons for redistribution

  • Use ShadowDraw’s instructional structure to create, sell, or offer for commercial purposes any derivative instructional materials, classes, products, or services

  • Sell ShadowDraw tutorial content as your own instructional material

4.3 Trademarks and Branding

The ShadowDraw name, logos, and branding are trademarks of Shadow Draw Inc. and may not be used without prior written consent.

5. Social Sharing; Limited Public Display Permission

ShadowDraw encourages users to share their drawing progress.

You may:

  • Share images of artwork you create

  • Share time-lapse videos of your drawing process

  • Share short screen recordings of yourself drawing within the App

  • Monetize such content on platforms such as YouTube

Provided that you do not:

  • Extract or distribute tutorial files

  • Upload full tutorial lessons in a way that allows others to replicate them

  • Remove copyright notices

  • Claim ownership of ShadowDraw instructional materials

This permission does not transfer ownership of App Content.

6. Subscriptions and Billing

6.1 Plans

ShadowDraw offers:

  • Free tutorial content

  • A seven (7) day free trial (when available)

  • Monthly subscription

  • Annual subscription

6.2 Apple In-App Purchases

All subscriptions are processed through Apple’s In-App Purchase system. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Subscription management and cancellation are handled through your Apple ID account settings.

6.3 Refunds

All refunds are handled exclusively by Apple under Apple’s policies. ShadowDraw does not issue refunds directly.

7. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble the App

  • Attempt to extract tutorial files or instructional data

  • Circumvent subscription restrictions

  • Use automated tools to scrape App Content

  • Remove proprietary notices

  • Use the App in violation of applicable law

Violation may result in termination of your license.

8. DMCA Copyright Policy

To provide ShadowDraw notice of an infringement, you must provide a written communication to the attention of “DMCA Infringement Notification Dept.” care of support@shadowdrawapp.com that sets forth the information specified by the DMCA (see http://www.copyright.gov/title17/92chap5.html#512). Please note that any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys’ fees, under 17 U.S.C. §512(f).

9. Disclaimer of Warranties; Updates; Maintenance

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

To the fullest extent permitted by law, ShadowDraw disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

ShadowDraw may modify, suspend, or discontinue any feature of the App at any time without notice. We are not responsible for any impact this may have on your use of the App, including loss or corruption of user-created artwork.

10. Limitation of Liability

To the maximum extent permitted by law, Shadow Draw Inc. shall not be liable for indirect, incidental, consequential, or punitive damages.

Total liability shall not exceed the amount paid by you for the App during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Shadow Draw Inc. and its affiliates from any claims arising out of:

  • Your misuse of the App

  • Your violation of these Terms

  • Your violation of applicable law

  • Your sharing or distribution of content containing third-party materials

12. Arbitration Agreement; Class Action Waiver

Any dispute arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association in Delaware.

You agree:

  • Arbitration will occur on an individual basis

  • You waive participation in class actions

  • You waive the right to a jury trial

If any portion of this section is unenforceable, the remainder shall remain in effect.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14. Apple-Specific Terms

These Terms are between you and Shadow Draw Inc., not Apple Inc.

Apple has no obligation to provide maintenance or support services for the App. Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or intellectual property infringement claims.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to Terms

We may modify these Terms from time to time. When we do, we will update the “Effective Date” at the top of this page and post the revised Terms on our website.

You are responsible for reviewing these Terms periodically. Your continued use of the App after the updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the App.

16. Severability and Force Majeure

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

ShadowDraw shall not be liable for delays or failures due to events beyond its reasonable control, including but not limited to natural disasters, strikes, or technical failures.
